A borrower subjected to such harassment has the right to lodge a complaint before the police, upon which the procedure prescribed under BNSS for registration of a First Information Report (FIR), investigation, and prosecution shall be followed in accordance with law. The jurisdictional Magistrate is also empowered to take cognizance of such offences and to ensure adherence to due process.
Additionally, recovery agents are bound by the guidelines issued by the Reserve Bank of India (RBI), which mandate fair, transparent, and non-coercive recovery practices. Any violation of these regulatory guidelines, when coupled with criminal misconduct, strengthens the borrower’s entitlement to seek legal remedies.
The BNSS framework ensures that victims of such harassment are afforded access to justice through established procedural safeguards, including protection of their rights during investigation, the guarantee of a fair trial, and remedies against abuse of authority.
