The passport authorities may rely upon information obtained through procedures recognized under BNSS, including police verification reports, records of investigation, and orders passed by competent courts.
In cases where an applicant is involved in a criminal case, is subject to pending warrants, or is restrained by any order of a competent court, the issuance of a passport may be refused, impounded, or granted subject to conditions, in accordance with the provisions of the Passports Act, 1967. The procedural aspects governing such criminal matters—such as investigation, filing of charges, and trial—are regulated by BNSS, thereby indirectly impacting the passport registration process.
Further, under BNSS, law enforcement agencies conducting verification are required to adhere to due process, ensuring fairness, accuracy, and legality in the preparation and submission of verification reports.
