Property disputes refer to conflicts arising between individuals or entities concerning ownership, possession, title, use, or transfer of movable or immovable property. Such disputes commonly arise in matters relating to land ownership, boundary disagreements, illegal possession or encroachment, tenancy issues, inheritance, partition of ancestral property, and fraudulent sale transactions.

In India, the substantive rights relating to property are primarily governed by statutes such as the Transfer of Property Act, 1882, the Indian Succession Act, 1925, and the personal laws applicable to the parties. However, the procedural and preventive framework for addressing disputes that may disturb public peace or involve criminal elements is governed by the Bharatiya Nagarik Suraksha Sanhita, 2023.

Under the BNSS, property disputes are addressed primarily from the standpoint of maintaining law and order and preventing breaches of peace, rather than adjudicating title or ownership. The relevant provisions empower Executive Magistrates to take preventive action in appropriate cases. The key aspects are as follows:

  • Disputes concerning land or water likely to cause breach of peace:
    The Executive Magistrate is empowered to intervene where a dispute relating to possession of immovable property is likely to disturb public tranquillity. The Magistrate may call for written statements from the parties, conduct an inquiry, and pass appropriate orders to maintain status quo or determine actual possession, until the rights of the parties are adjudicated by a competent civil court.
  • Attachment of property in cases of emergency:
    Where the Magistrate considers the dispute to be of an urgent nature, or where none of the parties appears to be in clear possession, the property may be attached, and a receiver may be appointed to manage the same until the dispute is resolved in accordance with law.
  • Disputes relating to rights of use (easements):
    Disputes concerning rights of way, water usage, or other easementary rights connected with property may also fall within the preventive jurisdiction of the Magistrate under the BNSS.
  • Role of police authorities:
    The police may take preventive measures in cases involving criminal trespass, unlawful dispossession, or threats of violence arising out of property disputes, and may initiate appropriate proceedings before the Executive Magistrate.

It is pertinent to note that proceedings under the BNSS do not determine ownership or title to property, as such matters fall exclusively within the jurisdiction of civil courts. The scope of BNSS is limited to preventing escalation of disputes into breaches of peace and ensuring interim protection of possession.

In addition to civil remedies, certain property disputes may also give rise to criminal offences such as cheating, criminal breach of trust, forgery, and criminal trespass under the Bharatiya Nyaya Sanhita, 2023, depending upon the facts and circumstances of each case.

Thus, property disputes in India involve a combination of civil adjudication for determination of rights, along with preventive and penal measures under BNSS and criminal law to maintain public order and address unlawful conduct.
